BD man pleads not guilty on drug charges

A Beaver Dam man who is accused of selling heroin and cocaine from his home on North Spring Street waived a preliminary hearing Thursday and pleaded not guilty to four felony charges.

Gino X. Montoya, 32, faces up to 73 years in prison if he's convicted of intending to deliver heroin and cocaine, possessing marijuana and maintaining a drug trafficking place.

When police served a search warrant to his home at 310 N. Spring St., on June 6, they reportedly found 31.2 grams of heroin, 27.2 grams of cocaine and 10.85 grams of marijuana inside, according to a criminal complaint.

Montoya reportedly told police that he resorted to selling drugs when he was laid off from his job in Mayville.

"What can I say, when times are tough you go back to what you know best and what you can make money on," Montoya told police, according to a criminal complaint.

According to online court records, Montoya was sentenced to prison for nine years and 364 days in 1999 when he pleaded no contest to one count of selling cocaine and two counts of selling marijuana. Additional charges of maintaining a drug trafficking place, possessing drug paraphernalia and six counts of bail jumping were dismissed in that case.

Montoya has been held on a $100,000 cash bond since his initial court appearance.
