Baraboo man gets time for 'mushrooms'

A Baraboo man will be spending some time as a guest of the Sheriff's Department and two years on probation after his conviction and sentencing Friday for possession of hallucinogenic "magic mushrooms" and involvement in their sale.

Steven E. Holmes, 26, appeared in Sauk County Circuit Court on a single count of possessing 500 grams (more than a pound) of psilocybin" with intent to sell.

In July of 2006, a state trooper pulled Holmes over in Lake Delton after he was spotted speeding on Interstate 90/94, according to court records. The trooper found he had been driving with a suspended license and the car was not his.

A representative of the firm that owned the car, who was also Holmes' mother, arrived on the scene.

She said he was using the car with permission, but gave consent for a search of the vehicle.

The trooper reported finding about 18 bags of mushrooms in the car, the documents state. He also found a disguised safe containing what he believed was a drug price ledger and cash totalling nearly $4,400.

Holmes told the trooper he was a courier for a drug merchant and was taking the mushrooms to another person on the dealer's behalf.

A State Crime Lab technician reported examining pieces of mushroom and cupcakes with mushroom pieces baked into them. Chemical testing found all of them contained the drug psilocybin, an illegal hallucinogen, the records state.

Holmes case has been delayed while his attorney argued evidence found during the search of the car should be suppressed. In July, Sauk County Circuit Court Judge Patrick Taggart ruled against Holmes.

He was originally scheduled for a jury trial, but later agreed to accept a plea deal.

In court Friday, Holmes pleaded no contest to the reduced felony charge of possessing less than 100 grams of the drug, records show.

The judge sentenced him to 30 days in jail and two years on probation. He must take alcohol and drug abuse treatment and must not buy any illegal drugs.

A Mauston woman traveling with Holmes, Amanda A. Didomenico, 24, was also charged with possessing the drug.

Her case has not yet been resolved and no hearings are listed in online court records at this time.
