Man faces charges for pictures of girl he met on MySpace

A former Wisconsin Dells man faces 15 years in prison on charges he met a 17-year-old girl in 2005 through her MySpace.com profile and took graphic pictures of her before they had sex.

David P. Nack, 34, now of Portage, pleaded guilty Monday to a felony charge of child enticement, which carries a maximum penalty of 25 years, including 15 years in prison, and a $100,000 fine.

Charges of delivery of THC (marijuana), child sexploitation, and two counts of sex with a child age 16 or older were dismissed as part of a plea agreement in which Assistant District Attorney Linda Hoffman said the prosecution would not argue for more than a 12-year prison sentence for Nack.

Nack is a life registrant on the Wisconsin Sex Offender Registry after he was convicted in March 1995 in Waukesha County of the sexual assault of a 15-year-old girl.

According to the Wisconsin Dells Police Department, the girl said she met Nack after he replied to her profile on MySpace, an online social networking Web site, and that she drove to meet him Nov. 2, 2005, to have sex. They met at a Walgreens store before going to his downtown Wisconsin Dells apartment, according to a criminal complaint.

The two smoked marijuana and Nack showed a pornographic movie on a television, the complaint states. Nack took pictures of the girl before they had sex, according to the complaint, and stopped when she began to cry and told him to stop.

Nack told police the girl changed into a short skirt and let him take pictures of her. He is being charged with child sexploitation for allegedly taking the pictures. He also is being charged with two counts of sexual intercourse with a child as well as child enticement and delivering marijuana to a minor.

A sentencing hearing will be scheduled within 90 days, and will take place after a pre-sentence investigation of Nack is completed.
