Legal Proceedings of the City of Fox Lake Common Council December 7, 2022 The regular meeting of the City of Fox Lake Common Council was held on Wednesday, December 7, 2022, at 6:30 p.m., in the council chambers. The meeting was called to order by Mayor Tom Bednarek and followed by the pledge of allegiance. Roll call was taken with alderpersons Dan Ault, Marcy Benz, Bruce Harned, Peter Hartzheim, Dennis Linke and John Mund present. Also attending were City Administrator Kelly Crombie, Police Chief James Rohr and City Clerk Jenny Quirk. There was no one in the audience. The clerk certified open meeting laws have been complied with. The Mayor opened the meeting to public comments on agenda items and other matters. Benz asked the City to look into setting up an ice rink. Motion by Mund, seconded by Linke to approve the minutes of the November 30, 2022 special council meeting. Motion carried with a voice vote. Motion by Mund, seconded by Ault to pay the bills, as audited, for accounts payable-check #43587 through #43671 totaling $286,020.88 (including ACH withdrawals) and payroll checks #61194 through #61238 checks totaling $42,540.63. Motion carried with a voice vote. Crombie provided his Administrator's report to the council. Motion by Harned, seconded by Benz to approve 2022 employee holiday gifts as follows: $100 Chamber of Commerce gift card for full time employees and $50 Chamber of Commerce gift card for part time employees. Vote in favor: Benz, Harned, Hartzheim, Linke, Mund and Ault. Motion carried. Motion by Harned, seconded by Mund to approve professional services agreement with MSA for the 2023 Center St. and Rosedale Ave. pavement replacement project. Vote in favor: Harned, Hartzheim, Linke, Mund, Ault and Benz. Motion carried. Motion by Linke, seconded by Hartzheim at 6:45 pm to adjourn to closed session pursuant to Wisconsin Statute 19.85(1)(c) considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercise responsibility. Specifically, to discuss vacation of the DPW director. Hartzheim, Linke, Mund, Ault, Benz and Harned. Motion carried. Motion by Linke, seconded by Ault at 6:53 pm to reconvene to session. Vote in favor: Linke, Mund, Ault, Benz, Harned and Hartzheim Motion carried. Motion by Benz, seconded by Hartzheim to provide 44 retroactive vacation hours to Gene Huettner, and place him on the vacation plan that was in place prior to May 6, 2016. Vote in favor: Mund, Ault, Benz, Harned, Hartzheim and Linke. Motion carried. Motion by Hartzheim, seconded by Ault at 6:55 pm to adjourn to closed session pursuant to Wisconsin Statute 19.85(1)(c) considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercise responsibility. Specifically, to discuss the search and candidates for City Treasurer. Vote in favor: Ault, Benz, Harned, Hartzheim, Linke and Mund. Motion carried. Motion by Benz, seconded by Hartzheim at 7:28 pm to reconvene to session. Vote in favor: Benz, Harned, Hartzheim, Linke, Mund and Ault. Motion carried. Motion by Mund, seconded by Benz to allow City Administrator Crombie to hire a part time employee on a limited term basis as needed, with terms and conditions determined by City Administrator. Vote in favor: Harned, Hartzheim, Linke, Mund, Ault and Benz. Motion carried. With no other business to come before the Council, motion by Harned, seconded by Linke to adjourn and go into the Committee of the Whole meeting. Motion carried with a voice vote.
