Andrew Voigt presiding, appointed John M. Wirth (the "Receiver") as the Chapter 128 receiver for the assets of Hughes Equipment Company, LLC ("Hughes"), a Wisconsin limited liability company, for the benefit of Hughes's creditors under Wisconsin Statutes Chapter 128. The Court has enjoined and restrained Hughes's creditors from commencing or prosecuting any other action or proceeding against Hughes or its assets other than an action in these proceedings. YOU MAY NOT TAKE ANY STEPS TO COLLECT ANY AMOUNTS OWING TO YOU FROM HUGHES EXCEPT THROUGH THE RECEIVERSHIP PROCEEDINGS.PLEASE TAKE FURTHER NOTICE that, if you believe that you are owed any money or have any other claim against Hughes, you must file a proof of claim with the Court ON OR BEFORE DECEMBER 26, 2019. All correspondence to the Court must reference the case number (Case No. 2019CV253). Pursuant to the Court's order, a copy of the proof of claim must also be provided to counsel for the Receiver on or before that date. Attorneys must file proofs of claim electronically. PLEASE TAKE FURTHER NOTICE that the order by which the Receiver was appointed authorized and approved a Cash Collateral Agreement between Ixonia Bank and the Receiver (the "Cash Collateral Agreement"). The Cash Collateral Agreement contains certain acknowledgments regarding the loan made by and lien in favor of Ixonia Bank and certain provisions allowing the Receiver to use cash proceeds and other cash collateral during the receivership. The terms and conditions of the Cash Collateral Agreement have been adopted and made the order of the Court.
