A 21-year-old rural Arlington man faces a felony charge stemming from allegations that he physically abused a 10-month-old baby boy.
Cody M. Russell has been charged with physical abuse of a child, a Class F felony that carries a maximum penalty of 12 years and six months in prison.
The charge stems from a Columbia County Sheriff’s Office investigation that began on Jan. 15.
According to the criminal complaint filed in Columbia County Circuit Court, Russell was caring for the child in the child’s town of Leeds home on Jan. 15.
He reportedly told the child’s mother that the child had cut his face by falling out of bed.
A Columbia County Sheriff’s Office report said deputies responded to a clinic in Sun Prairie where the child was being treated for his injuries — including numerous bruises and contusions on the scalp, neck and facial area.
According to the criminal complaint, Russell told a deputy that the injuries came from falling off a bed. But when the deputy said that the child’s injuries were not consistent with that explanation, Russell allegedly admitted that he had gotten angry with the baby because he was crying, picked him up by his neck and put him in the crib.
The sheriff’s office report said Russell picked up the baby by placing his right hand around the child’s neck and lifting him in the air. He then allegedly put the baby in his crib while his hand was around the child’s neck, then picked the child up by the hair and, while holding the child in the air by his hair, slapped the child on the back with an open hand.
Lt. Roger Brandner of the Columbia County Sheriff’s Office said the sheriff’s office contacted Child Protective Services, which placed the child with his mother.
Russell is next scheduled to appear in court Feb. 5 for a preliminary hearing before Judge W. Andrew Voigt.
